What BeniVita Is.  BeniVita is a health technology and connectivity platform. BeniVita provides software, technology infrastructure, administrative and non-clinical support services, and connectivity that allow users to access independent third-party healthcare professionals, pharmacies, laboratories, suppliers, and other healthcare service providers.

What BeniVita Is Not.  BeniVita is not a healthcare provider, medical practice, clinic, pharmacy, outsourcing facility, drug manufacturer, compounder, clinical laboratory, insurer, or health plan, and does not hold itself out as any of these.  BeniVita is not insurance.  BeniVita does not:

• practice medicine, pharmacy, nursing, or any other licensed healthcare profession; 
• diagnose, treat, cure, mitigate, or prevent any disease or medical condition; 
• provide medical, nursing, pharmacy, dental, behavioral health, nutritional, or other clinical care, advice, or supervision;
• manufacture, compound, prepare, test, label, package, prescribe, dispense, sell, ship, or distribute any drug, biologic, medical device, or dietary supplement;
• determine clinical eligibility or make any treatment, prescribing, or dispensing decision;
• guarantee that any user will be evaluated by, found eligible for, prescribed, or provided any product or service; or
• provide insurance, or guarantee coverage, reimbursement, or pricing.

Independent Providers.  All clinical services, evaluations, consultations, prescriptions, dispensing, and treatment decisions are furnished by independent, appropriately licensed healthcare professionals, pharmacies, and other qualified third parties, each of whom is solely responsible for the services they provide and for their own compliance with applicable law and professional standards. These providers are independent contractors and third parties. They are not employees, agents, partners, or joint venturers of BeniVita, and BeniVita is not responsible or liable for their acts or omissions. BeniVita does not control, direct, influence, or interfere with the exercise of independent professional judgment by any healthcare professional, and no provider is required or incentivized to prescribe, dispense, or recommend any particular product or course of treatment.

No Provider-Patient Relationship With BeniVita.  Accessing or using the BeniVita platform does not create a physician-patient, pharmacist-patient, or any other professional-patient or fiduciary relationship between you and BeniVita.

Not Medical Advice.  All information, content, tools, assessments, and materials made available through BeniVita are provided for general informational and educational purposes only. They are not medical advice and are not a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare professional who has evaluated you individually.

Emergencies.  Never disregard, avoid, or delay seeking professional medical advice because of anything you have read or accessed through BeniVita. If you think you may have a medical emergency, call 911 or your local emergency number immediately, or go to the nearest emergency department. If you are experiencing a mental health crisis, call or text 988 (in the United States).

Compounded Preparations.  Where compounded drug preparations are involved, you should understand that compounded drugs are not approved by the U.S. Food and Drug Administration. FDA does not review compounded preparations for safety, effectiveness, or quality before they are dispensed. Compounding is performed by independent licensed pharmacies or outsourcing facilities, not by BeniVita.

Dietary Supplements.  Where dietary supplements are involved, statements regarding those products have not been evaluated by the U.S. Food and Drug Administration. Such products are not intended to diagnose, treat, cure, or prevent any disease.

Variability and No Guaranteed Results.  Product and service availability, eligibility criteria, indications, contraindications, benefits, risks, side effects, interactions, outcomes, timelines, and pricing all vary depending on the individual, the clinical assessment performed, the product or service, the provider, and the jurisdiction. Individual results vary. No specific outcome, result, or benefit is promised or guaranteed. Any testimonial, case study, or example reflects an individual experience and is not representative of typical results.

Geographic, Eligibility, and Age Limits.  BeniVita’s platform and the products and services accessible through it are available only where BeniVita and its independent partners are authorized to operate, and are subject to eligibility requirements and applicable law. Nothing here constitutes an offer or solicitation in any jurisdiction where such an offer or solicitation would be unlawful. The platform is intended for users who are at least eighteen (18) years of age, or the age of majority in their jurisdiction, whichever is greater.

Third Parties and No Endorsement.  References to any third-party provider, product, service, or organization are for identification and convenience only and do not constitute an endorsement, recommendation, warranty, or guarantee by BeniVita.

Adverse Events.  If you experience an adverse reaction or side effect, seek medical attention promptly, contact your prescribing healthcare professional or dispensing pharmacy, and consider reporting the event to the FDA MedWatch program at www.fda.gov/medwatch or 1-800-FDA-1088.

Consult a Qualified Professional.  Always consult a qualified healthcare professional regarding your individual health needs, medical conditions, medications, and before beginning, changing, or discontinuing any treatment, product, or regimen.

No Warranty.  Except as expressly stated in writing, the BeniVita platform and all content are provided “as is” and “as available,” without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. This notice is qualified in its entirety by, and should be read together with, BeniVita’s Terms of Service and Privacy Policy, which govern in the event of any conflict.

Changes.  BeniVita may update this notice at any time. The version posted on the BeniVita platform is the operative version.
